My understanding is that most audio players that play mp3's also play AAC (also known at m4a) audio files, so in theory we could start shipping audio that way today, yes, no?

They may not know it, but will they bother to look at the extension, m4a, and if they do will they care?

These "mp3 is dead" stories are so typical of the perspective of the engineers and other nerds who develop the products they fancy as replacements for things currently in use. Just like the botanists and geneticists who may geek out over the benefits of GMOs (and there may very well be many), it is still up to the end users to decide they want to make the switch. Uhhh... The patents expired. That's a good thing for the rest of the world. Means anybody can use the MP3 format without paying a license fee to Fraunhofer (never mind that a whole lot of LAME users never paid it anyway...)
