If you want to elaborate a bit into it, you can add this one that I've had in a few recent contracts:

#. ARTIFICIAL INTELLIGENCE / SYNTHETIC RIDER

A) Client expressly agrees not to utilize any portion of the recording or performance of Talent for purposes other than those specified in the initial Agreement between the parties including but not limited to creation of synthetic voices or for machine learning.

B) Specifically, Client shall not utilize any recording or performance of Talent to simulate Talent’s voice or likeness, or to create any synthesized or “digital double” voice or likeness of Talent.

C) Client specifically agrees not to sell or transfer ownership of all or part of any of the recordings or performance of Talent to any third party without Talent’s knowledge.

D) Client agrees not to enter into any agreements or contracts on behalf of Talent which utilizes all or any part of any of the recordings or performance of Talent without Talent’s knowledge and consent.

E) Client agrees that any recordings or performances stored in digital format will be reasonably stored so that unauthorized third parties may not gain access to the files containing Talent’s voice or likeness, and if such files are stored in “the cloud” Client agrees to safeguard same through encryption or other “up-to date” technological means.

That's great, George. Has anyone pushed back even slightly to those stipulations?

Not yet to me. Although I'm lucky that for the moment the clients I'm working with don't have much interest in AI voices for their productions. I know it's coming and eventually some of them will take that plunge and that contract stipulation won't be necessary. I also know that if there's pushback on those stipulations that I have doubts about their future intent with what I'm giving them.

I am hoping that is true for this and other eLearning companies.

Exactly my feeling, as well. If they have no such intent, they should have no issues with signing such an agreement.

Thanks, George!

Thanks for sharing the contract wording, Mike and George! Great stuff, and sadly, definitely needed nowadays.

The verdict is in. After submitting my request to have the text suggested by George, prohibiting unauthorized use or sampling of my reads (for AI, etc), Learnnovators has responded, stating:

If you are not agreeable to the terms, then it is fine. We can understand."

I'm glad they understand.

I recently used the NAVA rider in a contract with a multi-national-name-you-would-recognize-client, and while they didn't go for the WHOLE rider, they DID add language that would protect me from AI harvesting. It wasn't all the way --- but they made an effort so I did too.
