Edited down for clarity:

Ended up booking a year-long campaign for a restaurant that airs in 16 states. I was going to submit for a Union opportunity in the same category (QSR), but noticed "Conflict: Restaurants." My agent says I now have a conflict.

Questions:

1) I didn't realize that this usage expansion to 16 states (of which there are 50) would preclude me from national spots; is there a threshold of some kind where it goes from "okay" to "conflict"?

2) Would this campaign be something I could leverage as I submit to LA and NY agencies, or do they view the conflict as a problem and maybe I should wait to submit?

"...I'll keep on sending QSR projects that are also not holding exclusivity. But anything in this domain that IS holding those conflicts will be off the table (unless it is something super specific in a state other than those [where the spots are running]).

Without a contract it is all slightly less binding, and often there is some grey area here (especially with VO) - but we would never want to upset a client or hinder any existing relationships!"

She then asked to be advised of the first use date once I become aware of it.

So, to answer my own questions: YES, unless it's obvious, you probably won't know you have a conflict until it happens. (e.g. 16 states--excluding huge coastal ones--out of all 50 is a conflict.) AND, darn toot'n I'm using this when submitting to LA and NY.
