I have followed this thread for sometime and I am glad that the client is willing to be flexible.
There is one form of coverage that I don't believe has been mentions and I don’t suggest that you mention it to the client either.
Errors and Omission (E& O) is useful for both client and vendor. In the event that they fail to fully vet your work product and an error or omission in not detected then they and you would have coverage. If you always use an acceptance and approval form then you are covered, (consult with you local legal advisor before taking into consider the aforesaid opinion).
In years gone by I required my clients to read, view and/or listen to all media I produced and have them execute an acceptance and approval form.
The project ranged from 5k to 30k in price. One client was a realtor and we were producing a cable TV program and they didn't look at every spot. To give them comfort and me protection I had a $1 million E&O policy.
E&O should be obtainable. Most mainline insurance agents (State Farm, Nationwide) are not knowledgeable about the kind/s of coverage that is need in business situations. When I first got into video production I asked my agent (he handled rental property and personal risk and peril for me) to find me coverage for the crew, the client and the gear. After a bit he said “ it look like I am going to have to place your business policy with Lloyds of London” that’s how hard it was to find the right agent. _________________ Esse quam videri "To be rather than to seem"
