Amy, know that at least one corner of the East coast is vibrating in sympathy. I think you've said everything that needs to be said to this person. I'm definitely not going to say anything else to him. He might not have meant it this way-- there is a big language barrier here-- but I felt threatened by his last email. Something about the phrase "and you will finish it" chilled me.

Not really an agency, per se. Voices dot com. Otherwise a nice agent would be helping me. Alas, I have only you... I wrote a nice note to my usual contact there:

Hi _________;

I just wanted to give you a heads-up. You're going to be getting a complaint about me! I guess he thinks you guys are going to fire me...

Anyway, a man in [Random Far Off South American Country] found me on Voices and asked me to record audio for his Flash animation. After trying very hard to understand his limited English, made worse by his bad VOIP phone line, I have realized that I must withdraw from his project. I won't bore you with the crazy details unless you're really hurting for entertainment over there, but suffice it to say that it is just impossible for me to try to work with him, and I am convinced that anything I do will not be good enough.

So, I very, very politely sent him an email withdrawing from the project and asked him to stop calling me on the phone (he has called me constantly and repeatedly since I first said I'd do his VO.) He is continuing to send me unintelligible emails in broken English, and from my best guess, is apparently refusing to let me withdraw!

His last email states plainly that, if I don't continue to work for him, he will report me to you! And he wants to remove the 5 stars he gave me, too, by the way. Since I won't be replying to him, I thought I'd just warn you about this.

Other than that, all is well! Have a great week, and you know where to find me if you need me!

There is one thing that upsets me most. One of the few things I could understand for sure was that he was going to see to it that the five stars he gave me on Voices would be removed. All five. He is not even going to give me one.

A crushing blow.

There is one other option which I can think of. Send him an invoice for the work already completed.

Four days @ say five hours per day = 20 hours.
20 hours multiplied by say a normal writers fee of $175.00 per hour = $3500.00.

Add a note which mentions this:

Quote:
"Dear ___________

If you insist upon my completing this project and when funds have cleared my bank, we may proceed with Phase Two of the script writing project. Phase Two will take approximately 120 hours. This project may take more time. All payments for services are "in-advance", with billing in ten hour increments.

To date, you owe $3500.00 USD, plus funds for ten hours in advance at $1750.00 for a total of $5250.00 USD, due this afternoon, Moday, January 8, 2007, for this project ot continue.

Again, let me stress it is in your best interest that we cease this affiliation. However, should you insist, you must understand that it cannot be completed in your suggested timeline. If this information is understood, payment should be made immediately.

If payment is not completed today, I will assume that you understand and have agreed to not contact me again until such time as you have a proper, complete, finished, edited, proper English - script.

Thank you for choosing me as your 'voice'. I will be monitoring my PayPal account throughout the day. Once those funds have cleared my bank, in approximately ten days, I will contact you for instructions regarding the next part of Phase Two.

Of course that means IF he pays, you have to continue working for the (expletive deleted).

Good Luck to you. To this point you just have to remember, "The customer is always right", even when he/she is wrong you can bill them for it.

I also think you are a star! So that is at least two stars from the VO-BB. Does that count?

At this point he is bordering on harassment via the telephone. There are some fairly stringent laws on the U.S. books regarding that.

Frank's post spelled out nicely what I was being much more vague about earlier, but you can "create" a new contract which spells out specifically the conditions in which you will work. Write it as you want it, email him a copy requiring his signature and remind him that you will not do any more work until it is signed and returned. Hell, if you need to threaten him with a lawsuit for harassment, so be it.

Your Voices.com stars are nice, but is there not a way to defend a negative? Is there a way to give (or take away) feedback for a client?
